Terms of Service

Terms governing access to h3-max.co, its AI video generation tools, credits, subscriptions, and API.

Last updated: 2026-09-04

These Terms of Service ("Terms") govern your access to and use of h3-max.co, including its website, AI video generation tools, accounts, credits, subscriptions, API, and related services (collectively, the "Services"). "We," "us," and "our" refer to the operator of h3-max.co.

By accessing or using the Services, creating an account, or purchasing credits or a subscription, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Services.

1. Eligibility and Authority

You must be at least 18 years old and have reached the age of legal majority where you live. If you use the Services for a company or another organization, you represent that you have authority to bind that organization, and "you" includes that organization.

2. Accounts and Security

You must provide accurate information and keep it current. You are responsible for activity under your account and for protecting your password, API keys, and devices. Do not share credentials, resell account access, or allow unauthorized users to use your account. Notify contact@h3-max.co promptly if you suspect unauthorized access.

We may reject registrations, require additional verification, reclaim identifiers, or limit accounts where reasonably necessary to prevent fraud, abuse, or security risks.

3. The Services

The Services let users submit text prompts and permitted source media to generate short AI videos and related output. Features, models, duration, resolution, queue priority, credit cost, limits, and availability may change as the product and upstream providers evolve.

AI generation is probabilistic. Outputs may be inaccurate, unexpected, offensive, incomplete, similar to another user's output, or unsuitable for your intended purpose. We do not guarantee a particular result, generation time, availability, quality, uniqueness, copyright status, or non-infringement.

References to MiniMax, Hailuo, H3 Max, fal.ai, or other third-party products and marks identify compatible technologies only. h3-max.co is an independent service and is not affiliated with, sponsored by, or endorsed by MiniMax or any third-party model owner unless expressly stated.

4. Your Inputs and Outputs

You retain any rights you already hold in prompts, uploaded files, and other material you submit ("Inputs"). As between you and us, and to the extent permitted by applicable law, we assign to you any rights we may have in outputs generated specifically for you ("Outputs").

You grant us a worldwide, non-exclusive, royalty-free license to host, reproduce, transmit, modify, and otherwise process Inputs and Outputs only as reasonably necessary to provide, secure, support, and improve the Services, comply with law, and enforce these Terms. This license ends when the content is deleted from active systems, except to the extent continued retention is technically necessary, legally required, or needed to protect the Services and users.

You represent that you have all rights, permissions, and consents needed to submit Inputs and use Outputs. You are solely responsible for reviewing Outputs before publishing or relying on them. We do not promise that an Output is eligible for intellectual-property protection or that it will not resemble existing material.

5. Acceptable Use

You must comply with our Acceptable Use Policy and all applicable laws. You may not use the Services to:

  • Exploit or sexualize minors, create non-consensual intimate imagery, or facilitate human exploitation.
  • Impersonate, defraud, harass, threaten, or meaningfully deceive another person.
  • Infringe privacy, publicity, copyright, trademark, or other rights.
  • Create or distribute malware, scams, illegal instructions, violent extremist material, or content that facilitates serious harm.
  • Evade safety controls, probe for vulnerabilities without authorization, disrupt the Services, overload infrastructure, or access another user's account or data.
  • Scrape, reverse engineer, resell, or provide unauthorized access to the Services, models, or API.

We may use automated and manual methods to detect violations. We may reject requests, remove content, restrict features, suspend or terminate accounts, preserve evidence, or report conduct when reasonably necessary or legally required.

6. API Use

If API access is available, you must protect API keys and comply with published documentation, rate limits, usage limits, and security requirements. You are responsible for end users and applications that use your keys. You may not expose keys in public code, circumvent metering, or use the API to build an unlawful or abusive service.

We may rotate or revoke compromised keys and may change or discontinue API versions with reasonable notice where practicable.

7. Credits

Credits are a limited, revocable license to consume eligible Services. They are not money, stored value, cryptocurrency, or transferable property; they cannot be redeemed for cash or transferred between accounts unless we expressly allow it.

Credit cost depends on the selected model, duration, resolution, and options and is shown before generation where practicable. We may reserve the estimated maximum cost when a task starts and reconcile the final cost after completion.

When our systems confirm that a generation failed because of a provider or platform error, the credits charged for that failed task are normally restored automatically. A credit restoration is not a cash refund. Credits are not restored when a task completed but the subjective result did not meet your preference, or when failure resulted from prohibited content, unsupported Inputs, user error, or circumstances outside our reasonable control.

Purchased and promotional credits may expire according to the validity period displayed at checkout, in your account, or in the applicable offer. Promotional or complimentary credits may have different limits and may be revoked if obtained through abuse, duplicate accounts, chargeback, or fraud.

8. Purchases, Subscriptions, and Taxes

Prices, billing intervals, included credits, and material plan limits are presented at checkout. Payments are processed by Stripe or another identified payment provider. You authorize the payment provider to charge the selected payment method, including applicable taxes.

Subscriptions renew automatically at the stated interval until canceled. You may cancel through the billing portal or account settings before the next renewal date. Unless the checkout terms state otherwise, cancellation stops future renewals and access continues through the paid billing period; unused subscription time is not converted to cash or transferred.

Except where required by law or expressly stated at checkout, purchases are non-refundable after credits are issued or computing resources are consumed. If we approve a cash refund, it will generally be returned to the original payment method. You must contact us before initiating a chargeback so we have a reasonable opportunity to investigate. A chargeback or payment reversal may result in credit reversal, account restriction, or suspension.

We may change future prices or plan features. Changes do not retroactively alter an already completed purchase. We will provide notice of material subscription pricing changes as required by law.

9. Commercial Use

If your plan states that commercial use is included, you may use Outputs for commercial purposes subject to these Terms, applicable law, third-party rights, and any restrictions disclosed for the selected model. A "commercial license" does not guarantee that an Output is unique, copyrightable, registrable, non-infringing, or suitable for a regulated or high-risk use.

10. Our Intellectual Property

The Services, software, site design, documentation, branding, and content we provide, excluding your Inputs and Outputs, are owned by us or our licensors and protected by applicable law. These Terms grant only a limited, non-exclusive, non-transferable, revocable right to use the Services while your account is in good standing.

You may not copy, modify, distribute, sell, lease, sublicense, reverse engineer, or create derivative works of the Services except where applicable law expressly permits it. Third-party names, models, logos, and trademarks remain the property of their respective owners.

11. Feedback

If you provide ideas or feedback about the Services, you grant us a perpetual, worldwide, royalty-free right to use that feedback without restriction or compensation, provided we do not publicly identify you without permission.

12. Third-Party Services

The Services depend on third-party providers for hosting, authentication, payments, AI generation, storage, analytics, and communications. Their terms and policies may apply to your use of those features. We are not responsible for third-party services, outages, policy decisions, or content beyond our reasonable control.

13. Suspension and Termination

You may stop using the Services at any time. We may limit, suspend, or terminate access if we reasonably believe you violated these Terms, created legal or security risk, failed to pay, abused promotions, or used the Services in a way that could harm us, our providers, users, or third parties.

Where appropriate, we may provide notice and an opportunity to appeal. Serious or repeated violations may result in immediate action. Upon termination, your right to use the Services ends. Provisions that by their nature should survive termination, including payment obligations, intellectual property, disclaimers, liability limits, and dispute provisions, will survive.

14. Service Changes and Availability

We may add, modify, limit, suspend, or discontinue features, models, pricing, or the Services. We will make reasonable efforts to notify users of material changes that adversely affect a paid subscription, but emergency, security, legal, or provider-driven changes may take effect immediately.

We do not promise uninterrupted operation or permanent storage of Inputs or Outputs. Download and securely retain any Output you need.

15. Disclaimers

To the fullest extent permitted by law, the Services are provided "as is" and "as available." We disclaim implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, and quiet enjoyment. We do not warrant that the Services or Outputs will be accurate, reliable, secure, uninterrupted, error-free, or suitable for professional, medical, legal, financial, safety-critical, or other high-risk decisions.

Nothing in these Terms excludes warranties or consumer rights that cannot lawfully be excluded.

16. Limitation of Liability

To the fullest extent permitted by law, we and our affiliates, licensors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenues, data, goodwill, or business opportunities arising from the Services.

To the fullest extent permitted by law, our total liability for all claims arising from the Services will not exceed the greater of (a) the amount you paid us for the Services during the three months before the event giving rise to the claim or (b) USD $100. These limits do not apply where liability cannot legally be limited, including liability for fraud, willful misconduct, or death or personal injury caused by negligence where applicable.

17. Indemnification

To the extent permitted by law, you will defend, indemnify, and hold us and our affiliates, personnel, and service providers harmless from third-party claims, losses, and reasonable expenses arising from your Inputs, Outputs, use of the Services, violation of these Terms, or infringement of another person's rights.

18. Governing Law and Disputes

These Terms are governed by the laws applicable at the operator's principal place of business, without regard to conflict-of-law rules, unless mandatory law in your place of residence requires otherwise. Courts with jurisdiction over the operator's principal place of business will have non-exclusive jurisdiction, subject to any mandatory consumer forum rights.

Before filing a formal claim, you agree to contact contact@h3-max.co and attempt in good faith to resolve the dispute informally for at least 30 days. This section does not prevent either party from seeking urgent injunctive relief or using a small-claims process where available.

19. Changes to These Terms

We may update these Terms as the Services or law changes. We will post revised Terms and update the date above. Material changes will be communicated through the Services or by email where reasonably practicable or legally required. Continued use after the effective date means you accept the revised Terms; if you do not agree, stop using the Services.

20. General Terms

These Terms, the Privacy Policy, the Acceptable Use Policy, and any checkout-specific terms form the entire agreement about the Services. If a provision is unenforceable, the remaining provisions remain effective. Failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them as part of a reorganization, financing, sale, or transfer of the Services.

The English version controls to the extent permitted by law if a translated version conflicts with it.

21. Contact

Questions about these Terms may be sent to contact@h3-max.co. Do not send payment card details, passwords, API keys, or other sensitive credentials by email.
